Terms of Service

These Terms of Service ("Terms") govern your access to and use of FormGen ("Service"), operated by FormGen ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

FormGen is a software-as-a-service platform that enables users to create, publish, and manage online forms. The Service includes an AI-powered form builder, form hosting, response collection, analytics, and related features. Forms can be rendered in conversational (one-at-a-time) or traditional (all-at-once) modes.

2. Account Terms

You must be at least 16 years old to use the Service. You are responsible for maintaining the security of your account credentials. You may not share your account with others or allow unauthorized access to your account.

You may authenticate using email and password, or through third-party OAuth providers (Google, GitHub). When using third-party authentication, you are also subject to that provider's terms of service.

Email verification is required for all accounts created with email and password authentication. You must verify your email address before accessing protected features of the Service.

3. Acceptable Use

You agree not to use the Service to:

  • Collect sensitive personal data (health, financial, government IDs) without appropriate legal basis and security measures
  • Send spam, phishing messages, or deceptive content through forms
  • Distribute malware, exploit vulnerabilities, or interfere with the Service's infrastructure
  • Violate any applicable law, regulation, or third-party rights
  • Circumvent rate limits, usage quotas, or other technical restrictions
  • Resell or redistribute the Service without written authorization
  • Upload or allow the upload of files that contain malware, violate third-party intellectual property rights, or are otherwise illegal

4. Intellectual Property

Your Content. You retain all ownership rights to the forms you create, the data you collect through those forms, and any content you upload to the Service. We do not claim ownership of your content.

Our Service. The Service, including its design, code, features, and branding, is owned by FormGen and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

AI-Generated Content. Forms generated using our AI features are your property. We do not retain rights to AI-generated form schemas or configurations created for your account.

5. Payment Terms

The Service offers free and paid subscription tiers. Paid subscriptions are billed monthly through Stripe. Prices are listed on our pricing page and may change with 30 days notice to existing subscribers.

Subscriptions renew automatically. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

If payment fails, we will attempt to charge your payment method for up to 7 days. If payment cannot be collected, your account may be downgraded to the free tier.

6. Data Handling

We process your data as described in our Privacy Policy. By using the Service, you consent to the data practices described therein. Our Cookie Policy describes the essential cookies we use for authentication and security.

You are responsible for ensuring that your use of the Service to collect data from respondents complies with all applicable data protection laws (including GDPR, CCPA, and similar regulations). FormGen acts as a data processor on your behalf when storing form responses. The terms of data processing are further detailed in our Data Processing Agreement.

During OAuth signup, we may set a temporary consent cookie to facilitate the authentication flow. This cookie is short-lived and deleted after use.

7. File Uploads

The Service allows form respondents to upload files through form fields. You are solely responsible for the legality, appropriateness, and intellectual property compliance of all files uploaded through your forms. FormGen performs server-side MIME type validation but does not inspect or moderate file content.

File size limits are determined by your subscription plan (10MB per file on Starter, 50MB per file on Pro). Files are stored in Cloudflare R2 and are accessible via pre-signed URLs that expire after 1 hour. Theme images (logo and background) are limited to 5MB regardless of plan.

8. Webhooks

The Service allows you to register webhook URLs to receive form submission data via HTTP POST requests. Webhook delivery is provided on a best-effort basis. FormGen makes up to 3 delivery attempts with exponential backoff and a 5-second timeout per attempt.

FormGen does not guarantee delivery of webhook payloads. Network failures, endpoint downtime, or misconfigured URLs may result in missed deliveries. You are responsible for monitoring webhook delivery and implementing appropriate error handling on your receiving endpoint. We strongly recommend using HTTPS endpoints for webhook delivery to protect submission data in transit.

9. Team Collaboration

Pro plan users may invite team members to their workspace. The workspace owner is responsible for managing team member access, including assigning appropriate roles (owner, admin, or member) and revoking access when it is no longer needed. The workspace owner remains responsible for all actions taken by team members within the workspace, including form creation, data access, and configuration changes.

Team invitation links expire after 7 days. Workspace owners and admins may remove team members at any time. The Pro plan supports up to 5 team members per workspace.

10. Custom Domains

Pro plan users may configure custom domains to serve their public forms. You are responsible for owning or having authorization to use any domain you configure with the Service. Domain ownership is verified via DNS TXT record validation, and you must maintain the required DNS records for continued operation.

FormGen does not provide domain registration services. You are responsible for domain renewal, DNS configuration, and any associated costs. FormGen may disable a custom domain integration if the domain verification lapses or if we receive a valid complaint regarding domain ownership.

11. AI Analytics

Pro plan users may use AI-powered analytics to generate insights from form responses. When you initiate an AI analysis, form response data (up to 100 responses per analysis) is sent to OpenAI for processing. By using this feature, you acknowledge and consent to the transmission of form response data to OpenAI in accordance with their data usage policies.

AI-generated insights (summaries, themes, per-field analysis, and recommendations) are provided for informational purposes only and should not be treated as definitive analysis. FormGen does not guarantee the accuracy or completeness of AI-generated content.

12. Partial Submissions

Pro plan users may enable save-and-resume functionality on their forms, which stores incomplete submissions as drafts. Drafts are associated with HMAC-signed resume tokens that expire after 7 days. Draft submissions that are not completed within 7 days are automatically deleted. FormGen does not guarantee the availability of draft data beyond the 7-day retention period.

13. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

14. Limitation of Liability

To the maximum extent permitted by law, FormGen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

15. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay subscription fees.

Upon termination, your form data will be retained for 30 days to allow export, after which it will be permanently deleted. You may request immediate deletion by contacting support.

16. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice in the Service at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
